hi I was unsure where to put this soz if its in the wrong place  as  many of you know I cared for mom for 14 years 24/7 before she die  , but Yesterday I received a registered letter from my sister who said:' she was requesting a copy of the will and would like to know why I had the house left to me when  my parents  who had 3 children  yet only 1 had a share?  and why had Carl who  had to get his own flat and leave the home while mom said he could always stay there? I wonted to give you a chance to reply before I seek legal advice from my solicitor
Can my sister still contest the will now or what? its seems stupid after all this time , below is some background

My  dad died 11th/ 11/1999 and  my mother died 19/4/2012 they had  3 children but both my parents agreed because of certain reasons they would leave the house to me and their granddaughter who is my daughter. I mention to my parents while they were alive  that you cannot just completely disregard the other 2 so can you maybe leave them something ? which they did £3000 each.
When my dad died I had to sort out the funereal as mom was too ill, my brother helped but  not money wise but dad saved so I had a enough  but my sister refused to help and did not come to the funeral despite my mother needed all the support

I became mom’s 24 /7 carer  as well as looking after my own family.  When mom died my daughter and I had to sort the funeral etc. out and pay for it , my sister refused to have anything to do with it saying she was too upset  and would,NT be attending the funeral yet a week after her death(  mom  was still in the hospital morgue) she came to mom’s house ( which would be more upsetting) and stole most of mom’s jewellery  which had been left to me . My solicitor said I had the right to report it to the police and take her to court but I just lost mom and that was the last thing I wonted to do.  I let my brother stay at the house rent free  as it was what mom wonted also he had no where else to go and she also said  if ever he has to go please find him a nice flat .He stayed at the house for 2 half years.
After a year living in the house  the gas was cut off due to the heating was faulty and unsafe so the only heating he had was electric fire  and in a way  he was glad cause he was struggling  already  just paying for the electric  in fact in took out loans to help him although I was against the ideaI did  try  to help him to economise.  The house was also full of damp and mould which was getting worse and seriously effecting his health and he was also wrecking the house,  he even threw hedge clippers down the street in a temper and a neighbour had to contact me to come over and calm him down while another called the police  , so it would seem it would only be a matter of time  before  he would have to leave. anyway plus he was being harassed by a girl.
In the meantime Carl  asked his sister if she could put him up while I modernise the house  which she refused to do  yet she has 2 houses    So .I could see no alternative but get a doctors note and get him a nice flat with the councils help  as he had no in money and  being on JSA his money was limited.  The council was good and offered him a couple of flats and so he took one which has proved better for him both financially and health wise.
'I cannot understand why she wrote asking for a copy    because  the  the will was at mom house and she had seen it many times  when she visited

I did not go through probate as Carl  my brother was living  there and I was thinking of renting it out later also my solicitor at that time said I don’t have to and as regards the £3000 it up to me when I pay them( either now or in the future if I sell the house)
Can my sister still contest the will now or what? a its seems stupid after all this time , any advice coffeex

First piece of advice Coffee, see a solictor, have a check in the Yellow Pages for those that do a free half hour, you could try also try CAB?

If you still have the same solicitor, maybe he could do one of those free half-hours as he would be familiar with the case - are they the same one who did the will?

You really need to get some expert advice.

I have no idea where you stand legally Coffee. Like Liz says you need expert advice &  seeing a solicitor ASAP seems a sensible first step

I'm sorry I am no help either.

Taking the jewellry from the house was a very underhand thing to do and since the solicitor knows about this you could I would think tell her you are reporting her for theft and tresspass. Maybe that would put ehr off?

i agree with the others get good legal advice and don't be afraid to stand up for what your parents wanted to happen with their estate. She is certainly dishonouring their memory. I am so sorry you are being put through this.

Sorry I can't help, only advise what others have said, seek legal advise from a Solicitor who specialize in these matters.

tha22222 all  for replying  i did get onto my solicitor who is at court today but will get back to me  tomorrow also I have asked him to apply for probate on my behalf .
I have wrote my sister a letter explaining some facts why Carl is now in a flat  and why the house was given to me and my daughter in fact i enclose the letter  I will send it tomorrow  and once again thankyo I feel abit better today  coffeex
